Terms of Service

1. Acceptance

By installing the Hueman Shopify app or using the Hueman service (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

The Service is operated by Lifecycle Innovations Limited, a company registered in Hong Kong SAR (“Hueman”, “we”, “us”).

2. Definitions

  • Merchant — a business that installs the Hueman Shopify app to offer shade matching to its customers.
  • Shopper— an end consumer who uses the shade matching feature on a Merchant's storefront.
  • Credits — the usage units that Merchants purchase to allow Shoppers to run shade analyses and try-on previews.

3. Merchant Responsibilities

As a Merchant, you agree to:

  • Maintain a valid Shopify store and comply with Shopify's own Partner Program Agreement and terms.
  • Keep sufficient Credits in your account to cover Shopper usage; Hueman is not responsible for service interruptions caused by a depleted Credit balance.
  • Ensure your product catalog data (shade names, images, descriptions) does not infringe third-party intellectual property.
  • Inform your Shoppers that shade matching is powered by Hueman and link to this page or our Privacy Policy if requested.
  • Not use the Service to process data for purposes unrelated to cosmetic shade matching.

4. Shopper Responsibilities

As a Shopper, you agree to:

  • Use the shade matching feature only for personal, non-commercial purposes.
  • Not attempt to reverse-engineer, scrape, or automate requests against the Service.
  • Acknowledge that shade recommendations are for guidance only; lighting conditions, screen calibration, and skin condition affect accuracy.

5. Credits and Billing

Merchants may purchase Credits in packs via the Service. All prices are in USD and exclude applicable taxes (VAT, BTW, etc.) which will be calculated at checkout.

  • Free trial: New Merchant installs receive 100 complimentary Credits, valid for 30 days. Unused trial Credits expire and cannot be extended.
  • Paid Credits: Purchased Credits do not expire unless stated otherwise at the time of purchase.
  • Refunds: Unused paid Credits may be refunded within 14 days of purchase. Contact support@hueman.beauty with your order reference. Credits that have been partially or fully consumed are non-refundable.

6. Acceptable Use

You must not use the Service to:

  • Upload illegal, offensive, or harmful content.
  • Attempt to bypass rate limits, authentication, or abuse detection.
  • Resell or sublicense access to the Service without our express written consent.
  • Use the Service in a way that could damage, overburden, or impair our infrastructure.

We reserve the right to suspend or terminate accounts that violate these provisions without prior notice.

7. Intellectual Property

The Service, including its software, algorithms, design, and brand assets, is owned by Hueman or its licensors. These Terms do not grant you any ownership rights. You may not copy, modify, or create derivative works from our proprietary technology.

Shade catalog data uploaded by Merchants remains the Merchant's property. By uploading it, you grant Hueman a limited licence to process and display it for the purpose of providing the Service.

8. Liability Cap

To the maximum extent permitted by the laws of the Hong Kong Special Administrative Region, Hueman's total liability to you for any claim arising out of or related to the Service is limited to the greater of:

  • The amount you paid for the Service in the 3 months preceding the claim, or
  • HK$1,000.

Hueman is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.

9. Warranty Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Shade recommendations are suggestions only. Hueman does not guarantee that recommended shades will match your skin tone exactly; results depend on lighting, device calibration, and individual variation.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts of Hong Kong SAR.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to Merchant account holders via email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
